Pet Nation Renovation : Contest Rules

  1. ELIGIBILITY. To be eligible for the Pet Nation Renovation ("Contest"), as of the start of the Contest Period, Nominated Shelters must meet the criteria set forth in Section 5. Officers, directors and employees of Discovery Communications, LLC ("Sponsor"), All3Media, Delta Faucet Company, and their partners, affiliated companies, advertising and promotional agencies ("Contest Entities"), as well as their immediate family members and/or those living in the same household (whether legally related or not) of each are not eligible to nominate shelters for the Contest. The Contest is void outside of the 48 contiguous United States and where prohibited by law.

The Contest is subject to all applicable federal, state, and local laws. Winning a prize is contingent upon fulfilling all requirements set forth with these Official Rules.

  2. CONTEST PERIOD. The Contest begins on January 29, 2017 at 9:00:01 AM Eastern Time ("ET") and ends on April 2, 2017 at 11:59:59 PM ET (the "Contest Period"). The Sponsor's computer or that of its designee is the official timekeeper for this Contest. Participants are responsible for determining the appropriate beginning and ending times in their respective time zones. The Contest Period is broken down into the following phases:

  1. CONTEST ENTRY DETAILS. During the Nomination Phase, entrants (hereinafter "Nominators") can nominate animal shelters for the Contest by creating a video regarding why the Nominated Shelter should be renovated. During the Nomination Phase, Nominators must (1) upload a video one to three minutes in length to their personal YouTube account (hereinafter "Entry Video"), and (2) visit, complete the entry form, and provide on the entry form the URL where the Entry Video is posted. The Entry Video and entry form will be considered the complete entry. There are no limits on the number of Entry Videos that a Nominator may submit. Nominators may nominate multiple animal shelters, and Nominators may submit multiple Entry Videos for the same animal shelter.


  1. ELIGIBILITY CRITERIA. To be eligible to win, animal shelters nominated for the Contest must: (1) be part of the 48 contiguous United States; (2) be a 501(c)(3) organization that has raised over $35,000 per year for the past three years; (3) be willing to accept and pay any taxes on the renovations and improvements completed; (4) be the owner of the building that will be renovated, or alternatively, have permission from the owner/landlord of the building to make renovations; (5) be in compliance with all applicable laws, regulations, guidelines, procedures, or other requirements to operate as an animal shelter in the jurisdiction where it is located; (6) be in good standing before the applicable regulating authorities to operate as an animal shelter in the jurisdiction where it is located; (7) provide proof of shelter license (if applicable in the jurisdiction where the animal shelter is located) and other applicable, federal, state or locally required documentation; (8) be willing and able to give production access to tape at the facility between the months of May through July, 2017, including weekends; (9) be willing to participate in a television program and willing to give individuals involved in the production of the program final creative approval of the renovation plans; (10) be willing to allow the renovation team to tear down walls if deemed necessary; (11) provide proof in the form of an affidavit or declaration that all animals at the shelter are free from infectious disease or physical abnormalities that would endanger the animal, other animals, or the general public; (12) provide proof of vaccination and spay and neuter policies; (13) willing to disclose how the animal shelter obtains and sources its animals; and (14) have liability insurance of $2,000,000.

All animal shelters nominated for the Contest and meeting the criteria above are referred to as "Nominated Shelters." Participation constitutes Nominator's and Nominated Shelter's full and unconditional agreement to these Official Rules and Sponsor's decisions, which are final and binding in all matters related to the Contest.

In the event of a dispute as to any entry, the authorized account holder of the email address used to register the YouTube account will be deemed to be the entrant. The authorized account holder is the natural person assigned an email address by an Internet access provider, online service provider, Internet service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. No software-generated, robotic, programmed, script, macro or other automated online or text message entries are permitted.

Any elements that appear in an Entry Video, including, without limitation, brand names, logos, building signage, or images, should be either: (1) entirely original, created by the entrant; (2) property of the Sponsor; or (3) in the public domain. Use of any other elements will result in disqualification of an entry, in the Sponsor's sole discretion. Entries should be in English. Entries should not contain personally identifiable information such as last names, addresses, phone numbers, screen names, email addresses, etc. Nominators must not engage in any violent, dangerous, or illegal behavior in creating an entry. Entries must not contain inappropriate content, including but not limited to nudity, drug use, smoking, vulgarity, obscenity, lewd, pornographic or violent material, real weapons of any kind, or materials which promote violence. Entries must reflect the spirit of the Contest and must not threaten, abuse, harass, libel, embarrass defame or invade the privacy or publicity rights of any person, living or deceased, or otherwise infringe upon a person's personal or proprietary rights.

By submitting an Entry Video, Nominators represent and warrant that: (1) they have obtained written permission from each person whose image or likeness is included in the entry; (2) no person under the age of 18 appears in the Entry Video without expressed permission from the child's parent or guardian; (3) if they are not the person who took the Entry Video, they have obtained written permission from the person who took the Entry Video and such person has granted all necessary rights to enter the Entry Video in the Contest; and (4) they can and will give written copies of such permissions to the Sponsor upon request. Sponsor reserves the right to request proofs of these documents at any point in time, and such documents may be required in order to be deemed an official finalist or winner. Failure to provide said proof may result in disqualification of the associated entry.

Entry Videos will be considered void and will not be included in the voting or judging of the Contest if they do not adhere to the requirements set forth in these Official Rule or if they incorporate a third-party's intellectual property without authorization or as otherwise permitted by law, at Sponsor's sole discretion. Entries that are deemed by Sponsor in its sole discretion to be immoral, obscene, profane or not in keeping with Sponsor's image will be disqualified.

All Entry Videos meeting the criteria set forth in these Official Rules are Eligible Nominations.


Potential Winner Selection - On or about March 2, 2017, a panel of judges chosen by the Sponsor will choose five potential winners from among all Eligible Nominations received. Potential winners will be selected based on the following criteria: (1) Nominated Shelter's past and potential future impact on the community where it is located (25%); (2) Nominated Shelter's commitment to animal welfare (25%); (3) the character, enthusiasm, and appeal of the Nominated Shelter, its employees and volunteers (25%); and (4) Visual appeal of Entry Video (25%). Additional consideration may be given to Nominated Shelters that (1) supply two letters of recommendation from a veterinarian or other professional within the animal shelter community; (2) provide proof via an affidavit of $100,000 in annual donations for 2016; and (3) have a kennel facility that houses at least 30 animals. To be considered, letters of recommendation and affidavits must be submitted to before the close of the Nomination Period on March 1, 2017 at 11:59:59 PM ET. Sponsor may select fewer than five potential winners if an insufficient number of Eligible Nominations is received.

Potential Winner Notification - On or about March 14, 2017, Sponsor will contact the five potential winners via phone, email, postal mail, or direct message on YouTube. Potential winners must respond to the notification message within 48 hours or the prize will be forfeited and another potential winner may be selected. Each potential winner will be asked to submit to a background check and submit an affidavit of eligibility in order to be eligible to win a prize. All decisions of the judges and Sponsor are final and binding in all matters relating to the Contest. In the case of a tie, the entry with the highest "character, enthusiasm, and appeal of the Nominated Shelter" score will be deemed the winner.

  1. PUBLIC VOTING. On March 19, 2017, Sponsor will post the Entry Videos of the five potential winners to The five potential winners will not be posted or ranked in any specific order. Fans will have the opportunity to vote for their favorite potential winner from March 19, 2017 at 9:00:01 a.m. ET to April 2, 2017 at 11:59:59 p.m. ET.
  2. CONTEST PRIZES. The prizes listed below will be awarded.

Grand Prize - One Grand Prize Winner will be selected from the five potential winners using the judging criteria described in Section 6. In selecting the Grand Prize Winner, Sponsor will consider the results of the public voting round described in Section 7. However, the results of the public voting round are not determinative of the Grand Prize Winner. IN SPONSOR'S SOLE DISCRETION, THE GRAND PRIZE MAY OR MAY NOT BE AWARDED TO THE POTENTIAL WINNER WHO RECEIVES THE MOST PUBLIC VOTES.

The Grand Prize consists of a renovation of the Nominated Shelter by a team of remodeling, design, and construction professionals using products and equipment supplied by Delta Faucet Company. The particular aspects of the renovation and the value of the renovation will vary based on the winning shelter's existing facilities and requirements. The Approximate Retail Value ("ARV") of the Grand Prize renovation is $50,000. The value of the renovation may (but is not guaranteed to) exceed this amount, depending on the winning shelter's existing facilities and requirements. Actual retail value may vary and Sponsor will not award the difference between the ARV and actual value. The Grand Prize Winner will be notified on or about April 15, 2017.

Runner-Up Prizes - Four runner-up prizes will be awarded to each of the four potential winners not chosen as the Grand Prize Winner. Each runner-up prize consists of Delta products valued at $500. The aggregate ARV of the runner-up prizes is $2,000.

The aggregate value of all prizes awarded is at least $74,000.

The odds of winning depend on the number of Eligible Nominations received and the quality of the Entry Video submitted. Prizes are non-transferable and are not redeemable for cash. No prize substitution, in whole or in part, except by Sponsor due to prize unavailability, safety or security considerations, or any other reason as solely determined by Sponsor in which case a prize of comparable or greater value will be awarded. Winners must look to the prize manufacturer for warranty issues; Sponsor not liable for performance of any aspect of the prize. All details of any prize not specified herein shall be determined solely by Sponsor. By accepting a prize, each winner acknowledges compliance with these Official Rules. All taxes on Prize and all expenses related to acceptance and use of Prize and not specified are sole responsibility of winner. Sponsor reserves the right to make any and all decisions regarding the prize including but not limited to, the size, materials used and amenities included in the Nominated Shelter.

  1. MOBILE DISCLOSURE. By using your wireless mobile device in connection with the Contest, depending on your phone's capabilities, standard text messaging rates or data charges may apply according to the terms and conditions of your service agreement with your wireless carrier. Other charges may apply (such as normal airtime and carrier charges) and may appear on your mobile phone bill or be deducted from your prepaid account balance. Wireless carriers' rate plans may vary, and you should contact your wireless carrier for more information on messaging rate plans and charges relating to your participation in this Contest.
  2. LICENSE. By submitting an Entry Video into the Contest, Nominators grant to the Contest Entities the right, without limitation, to display the Entry Video in any media now known or hereinafter developed. Nominators further agree to grant to the Contest Entities a world-wide, royalty free, non-exclusive, perpetual, irrevocable license to reproduce and use the entry for any purpose whatsoever without compensation or further permission, including but not limited to an irrevocable and perpetual, royalty-free, worldwide right, in all media (now known or later developed) to assign, sub-license, use, publish, edit, adapt, modify, alter, reproduce, distribute, broadcast, display, copyright, create derivative works or otherwise exploit the entry for commercial or non-commercial use, and without compensation to the entrant.
  3. RELEASE. By participating, Nominators, Nominated Shelters, and landlords (to the extent a Nominated Shelter does not own the property where it is located) agree to release, discharge and hold harmless Contest Entities, their subsidiaries and affiliates from any and all injuries, liability, losses and damages of any kind resulting from their participation in the Contest or their acceptance, use or misuse of Prize including, without limitation, personal injury, death and property damage; and if a winner, to the use of his or her name, likeness and/or Entry Video for advertising, publicity and promotional purposes in all media, including but not limited to on air and within, without compensation (unless prohibited by law) and agree to execute specific consent to such use upon request. In addition, the potential winners (and their landlords, to the extent a Nominated Shelter does not own the property where it is located) may be required to submit to a background check and complete an affidavit of eligibility, a talent agreement, a liability release and (where legal) a publicity release, which must be returned within the time period specified by the Sponsor in the notification. If documents are not returned timely, or if any notification or Prize is returned as non-deliverable, or if a potential winner is found to be ineligible or not in compliance with these Official Rules, the Prize may be forfeited and an alternate potential winner may be selected.

Contest Entities are not responsible for and shall not be liable for: electronic, hardware or software program, network, Internet, or computer malfunctions, failures, or difficulties of any kind, including without limitation, server malfunction or for any human, typographical, printing or other error relating to or in connection with the Contest, including, without limitation, errors which may occur in the administration of the Contest, processing of entries; the announcement of the Prize or in any Contest-related materials, failed, incomplete, garbled, or delayed computer transmissions; late, lost, misdirected, or incomplete entries; damage to Nominator's or any person's computer or the contents thereof; any condition caused by events that may cause the Contest to be disrupted or corrupted; or any damage to Prize during shipping or delivery.


  1. GENERAL CONDITIONS. Sponsor reserves the right in its sole discretion to cancel, terminate, modify, or suspend the Contest if fraud, technical failures or any other factor beyond Sponsor's reasonable control impairs the integrity of the Contest (or portion thereof), as determined by Sponsor in its sole discretion, and limit entries to those submitted prior to the action taken, or to proceed in such a manner as may be deemed fair and equitable by Sponsor in its sole discretion. Any attempt by an entrant to deliberately damage any web site or undermine the legitimate operation of the Contest may be a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Potential winners may be required to show proof of being the authorized account holder. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds to be tampering with the entry process, voting process or the operation of the Contest; to be acting in violation of the Official Rules; to be acting in violation of the terms of YouTube, or to be acting in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Entries may not be made by any other individual or any entity, and/or originating at any other Internet website or e-mail address, including but not limited to commercial sweepstakes subscription notification and/or entering service sites. Any winner who enters by any of the methods described above will be disqualified and an alternate winner selected.
  2. DISPUTES. All disputes related to the Contest, the Prize awarded, or these Official Rules shall be governed by, and construed in accordance with, the laws of the State of Maryland, without giving effect to any choice of law or conflict of law rules (whether of the State of Maryland or any other jurisdiction). Participants consent to the exclusive jurisdiction and venue of state and federal courts in Montgomery County, Maryland, and all claims must be resolved in the courts of Montgomery County, Maryland.
  3. USE OF ENTRY INFORMATION. By entering this Contest, you are agreeing to receive information from Sponsor related to the Contest. The collection and use of entrant information will be governed by Discovery's on-line privacy policy, available for viewing at
