Official Rules

 

NO PURCHASE NECESSARY TO ENTER OR WIN. VOID WHERE PROHIBITED BY LAW.

1. Talent Search Sponsor and Administrator: Discovery Communications, LLC, One Discovery Place, Silver Spring, MD 20910 ("Talent Search Sponsor") will sponsor the "America's Next Cat Star Talent Search" ("Talent Search"). Talent Search Sponsor will be assisted in the administration of the Talent Search by Promotion Mechanics, Inc., 87 South Main St., Newtown, CT, 06470 ("Talent Search Administrator").

2. Eligibility: To be eligible for the Talent Search, as of the start of the Talent Search Entry Period (defined below), entrants must (i) be legal residents of the fifty (50) United States or the District of Columbia, (ii) have reached the age of majority in their state of residence and be at least eighteen (18) years old, (iii) have (a) a computer with internet access or (b) a mobile device with internet access that utilizes the iOS or Android platform, (iv) have a valid YouTube account, (v) be willing to appear with his/her cat in a television program that will air on or about April 20, 2015 (and related advertising and promotions) ("Program"); and (vi) be available for filming and interviews to take place either in their home between February 23, 2015, and March 20, 2015, if selected as a Talent Search Finalist (defined below), or in New York, NY, between March 11, 2015, and March 15, 2015, if selected as America's Next Cat Star.

Officers, directors and employees of Talent Search Sponsor, Talent Search Administrator, and their partners, affiliated companies, advertising and promotional agencies are not eligible to participate (collectively, the "Talent Search Entities"), and each of their immediate family members and/or those living in the same household (whether legally related or not) of each are not eligible to enter or win. Being selected as America's Next Cat Star is contingent upon fulfilling all requirements set forth herein. The Talent Search is void outside the fifty (50) United States and the District of Columbia and where prohibited by law. Participation constitutes entrant's full and unconditional agreement to these Official Rules and the decisions of Sponsor and Talent Search Administrator, which are final and binding in all matters related to the Talent Search. This Talent Search is in no way sponsored, endorsed or administered by, or associated with, YouTube. The Talent Search is subject to all federal, state, and local laws.

3. Talent Search Entry Period: The period during which entrants may enter the Talent Search begins on February 1, 2015, at 12:00 PM Eastern Time ("ET") and all entries must be received no later than February 22, 2015, at 11:59 PM ET (the "Talent Search Entry Period"). The Talent Search Sponsor's computer or that of its designee is the official timekeeper for this Talent Search.

4. How to Enter: To enter, entrant must submit the following materials that are owned by entrant (the "Materials"): (i) a photograph of entrant's cat; and (ii) a video featuring entrant's cat. Both must be submitted online at www.animalplanet.com/americasnextcatstar (the "Entry Page"). The photograph must be uploaded directly at the Entry Page. By contrast, the video must first be uploaded to the entrant's personal YouTube account. A URL linking to the uploaded video should be pasted into the designated field at the Entry Page. A YouTube account can be set up at no cost. Entrant must also provide any additional information requested at the Entry Page. Entrants should confirm that the privacy settings of the YouTube account allow the video to be viewed publicly.

All Materials must conform to the Entry Requirements (defined below). All entries must be submitted during the Talent Search Entry Period. Talent Search Sponsor is not responsible for failure to see or receive an entry. For purposes of this Talent Search, an "Eligible Entry" is defined as the submission of the required photograph and video, both of which follow the technical, creative, and legal requirements disclosed in the advertising for this Talent Search and elsewhere in these Official Rules, including, without limitation, the Entry Requirements below. Entries become property of Talent Search Sponsor and will not be acknowledged or returned.

Only one (1) entry per eligible entrant will be permitted. Submission of multiple entries during the Talent Search Entry Period may disqualify entrant from the Talent Search. In the event of a dispute, each entry will be deemed to be submitted by the authorized account holder of the email address provided at time of entry. Entries generated by a computer program or by macro, programmed, robotic or other automated means will be disqualified. Entries that are incomplete, corrupted, false, lost, late, misdirected, deceptive or otherwise not in compliance with the Official Rules may be disqualified from the Talent Search at the sole and absolute discretion of Talent Search Sponsor or its designee. Proof of photograph or video submission does not constitute proof of entry.

5. Entry Requirements: Photograph submissions may be no larger than 5 MB in size, must be in JPG or GIF format, and must feature entrant's cat. Video submissions must be no longer than three minutes in length. The video must also feature the entrant's cat, and must include a brief text synopsis in the description of the YouTube video explaining why the entrant's cat deserves to be crowned "America's Next Cat Star." Entrant must be the owner of the cat featured in the Materials and must be the owner of all Materials submitted. By submitting an entry, entrant agrees to provide Talent Search Sponsor, upon request, with additional photographs and videos of entrant's cat. FAILURE TO RESPOND TO SUCH A SUPPLEMENTAL REQUEST MAY SUBJECT ENTRANT TO DISQUALIFICATION, AT SPONSOR'S SOLE AND ABSOLUTE DISCRETION. If selected as a Talent Search Finalist (defined below), entrants must be willing to sign documentation in connection with the Program (e.g., Affidavit of Eligibility, Animal Owner Release, Appearance Release, Footage/Photo Release, Location Release).

Any Materials that do not meet the following requirements will also subject entrant to disqualification. To be eligible, an entry: (i) must be in keeping with the spirit of the Talent Search; (ii) may not be obscene, indecent, or otherwise offensive (as determined by Talent Search Sponsor in its sole discretion); (iii) may not defame or invade the publicity or privacy rights of any person, living or deceased; (iv) may not infringe, violate, or misappropriate any person's or entity's personal or proprietary rights (including copyrights, trademarks, or other intellectual property rights); (v) may not contain (a) any words, statements, or images considered offensive to individuals of any age, race, ethnicity, national origin, religion, sexual orientation, or other protected class, or who are disabled, (b) any threats to any person, place, business, group, or entity, (c) materials that promote bigotry, racism, hatred or harm against animals or any group or individual or promote discrimination based on age, race, ethnicity, national origin, religion, sexual orientation or other protected class, or disability, (d) any materials that depict illegal acts, are sexually explicit, libelous, obscene, violent, hateful, slanderous, (e) or any content not in keeping with Talent Search Sponsor's reputation and image; and (vi) may not be owned by a third-party and/or be subject of or to any restriction or right that would in any way limit Talent Search Sponsor's right to use the entry as permitted under these Official Rules.

Do not include in your Materials any images, graphics or trademarks belonging to any third parties or incorporating the names, likenesses or personas of any party other than yourself unless you have obtained all rights necessary to permit you to use the same in connection with your entry and grant the rights herein granted to Sponsor. No entry should reveal any personal information about another individual, including another person's address, phone number, e-mail address, credit card number or any information that may be used to track, contact, or impersonate that individual.

6. America's Next Cat Star Talent Search Selection & Notification: A panel of cat experts, selected by Talent Search Sponsor, will evaluate each Eligible Entry according to the following judging criteria:

  • (i) Originality (20%);
  • (ii) Most Photogenic (20%);
  • (iii) Most Talented (20%);
  • (iv) Uniqueness (10%);
  • (v) Comical (10%);
  • (vi) Cutest (10%); and
  • (vii) Outrageousness (10%)

Judging will occur between February 23, 2015, and March 4, 2015. The five Eligible Entries with the highest combined score will be named "Talent Search Finalists." Talent Search Finalists will be notified of their selection no later than March 9, 2015, via the contact information provided in the entry form. Talent Search Finalists must respond within forty-eight (48) hours accepting their selection as Finalists or Talent Search Sponsor may select an alternate Finalist. By accepting selection as a Talent Search Finalist, entrant agrees to permit Talent Search Sponsor to conduct interviews and filming in entrant's home between February 23, 2015, and March 20, 2015. With such acceptance, Talent Search Finalists also agree that the resulting information and video footage may be used by Talent Search Sponsor on television in the event that entrant is selected and crowned America's Next Cat Star.

The Talent Search Finalist with the highest overall score based on the judging criteria described above will be designated the overall winner ("America's Next Cat Star"). The potential America's Next Cat Star will be notified between March 1, 2015, and March 8, 2015, via the contact information provided in the entry form. The potential America's Next Cat Star winner must respond within forty-eight (48) hours accepting prize (defined below) or Sponsor may select an alternate America's Next Cat Star. In the event of a tie, either with respect to the five Talent Search Finalists or America's Next Cat Star, the entry receiving the highest score in the "Originality" category will be named the Finalist or Cat Star, as appropriate. Judges' decisions are final and binding. By accepting selection as America's Next Cat Star, entrant agrees to be available for filming in New York, NY, between March 12, 2015, and March 14, 2015. If the Talent Search Finalists or America's Next Cat Star decline the prize, are not eligible or are not available during the required dates, Talent Search Sponsor reserves the right to select alternate Finalists or Cat Star according to the judging criteria above.

7. Prizes, Approximate Retail Value, and Odds of Winning: America's Next Cat Star will receive a three-night trip to New York, NY, for the entrant and entrant's cat, including three-nights at a pet-friendly hotel, coach-class roundtrip airfare (including the cost of transportation for entrant's cat) from the major airport nearest to entrant's residence, transportation to and from the airport, and spending money for meals (entrant only, three meals per day; meals for entrant's cat not included). Total Approximate Retail Value: $4,000. Odds of winning depend on number of entries and skill of the entrants. All other expenses not explicitly specified herein are the responsibility of the winner. Prize fulfillment is based on availability. ALL TAXES IMPOSED ON PRIZES ARE THE SOLE RESPONSIBILITY OF THE WINNER. Talent Search Sponsor reserves the right to substitute a prize of equal or greater value in its sole discretion, unless such substitution is prohibited by law. Talent Search Sponsor may disqualify a potential winner and select an alternate winner if any prize is returned undeliverable or unclaimed. Prizes are non-transferable and may not be redeemed for cash. Talent Search Sponsor reserves the right to substitute a prize of equal or greater value.

TRAVEL: All aspects of the travel portions of the prize must take place between March 11, 2015, and March 15, 2015. All travel details will be at Talent Search Sponsor's discretion. Prize will be forfeited if America's Next Cat Star is unable to travel during designated time period and alternative America's Next Cat Star will be selected according to the judging criteria above. Entrant is responsible for ensuring that entrant's cat is prepared, authorized, and fit to fly. No compensation will be made in the event of the cancellation or delay of any flight. Airline tickets are non-refundable and non-transferable and are not valid for upgrades or frequent flyer miles. All airline tickets are subject to the vagaries of flight variation, work stoppages, and schedule or route changes. If in the judgment of Talent Search Sponsor, air travel is not required due to winner's proximity to prize location, ground transportation will be substituted for roundtrip air travel at Talent Search Sponsor's sole discretion.

America's Next Cat Star must comply with any applicable hotel check-in requirements, such as presentation of a major credit card. Room taxes and other hotel fees may not be included and if applicable may be payable at the time of check-out by the winner or guest. All expenses and incidental travel costs not expressly stated in the package description above, which may include but not be limited to, ground transportation, meals, incidentals, passenger tariffs or duties, surcharges, airport fees, service charges or facility charges, personal charges at lodging, security fees, taxes or other expenses are the sole responsibility of America's Next Cat Star.

The ARV for travel prizes is an estimate made before the Talent Search begins and may vary depending upon points of departure and destination and fare fluctuations. America's Next Cat Star will not receive cash or any other form of compensation if actual travel costs are less than the estimate made in these Official Rules. No interest will be awarded on cash prizes.

In the event entrant or entrant's cat engage in behavior that, as determined by Talent Search Sponsor in its sole discretion, is obnoxious, threatening, disruptive, dangerous, illegal or that is intended to annoy, abuse, threaten or harass any other person, Talent Search Sponsor reserves the right to terminate the trip or other applicable experience early, in whole or in part, and send the entrant home with no further compensation.

The restrictions and conditions stated herein are not all-inclusive and the described above may be subject to additional restrictions and conditions, which may be stated in any correspondence with Talent Search Sponsor or other travel documents.

8. Entrant Representations and Warranties. By entering the Talent Search, entrants represent and warrant that they are the sole and exclusive owner and rights holder of the Materials and submitted entry and that they have the right to submit the Eligible Entry in the Talent Search and grant all required licenses and assignments. Each entrant agrees not to submit any entry that infringes any third party proprietary rights, intellectual property rights, industrial property rights, personal or moral rights or any other rights, including without limitation, copyright, trademark, patent, trade secret, privacy, publicity, and confidentiality obligations. Entrants also represent and warrant that they have not previously submitted their entry as an entry in another talent search, promotion, competition, or similar activity.

9. Indemnity. To the maximum extent permitted by law, each entrant indemnifies Talent Search Sponsor at all times from and against any and all liability, claims, demands, losses, damages, costs and expenses resulting from any act, default or omission of the entrant and/or a breach of any warranty set forth herein. To the maximum extent permitted by law, each entrant agrees to defend, indemnify and hold harmless Talent Search Entities from and against any and all claims, actions, suits or proceedings, as well as any and all losses, liabilities, damages, costs and expenses (including reasonable attorneys fees) arising out of or accruing from (i) any entry or Materials submitted by the entrant that infringes any copyright, trademark, trade secret, trade dress, patent or other intellectual property right of any person; (ii) any misrepresentation made by the entrant in connection with the Talent Search; or (iii) any non-compliance by the entrant with these Official Rules.

10. Release, Publicity, and General Terms: By participating in the Talent Search, entrants: (i) agree, to the fullest extent of the law, to release and hold harmless Talent Search Entities from any and all liability for any injuries, loss or damage of any kind arising from or in connection with the Talent Search, whether to themselves or to their cat, and (ii) grant to Talent Search Sponsor the right to use and publish their proper name and state, statements, photograph, voice and/or likeness for any advertising and promotional purposes relating to the Talent Search, in any media now known or hereafter devised, without further notice, compensation, consideration, review or consent and without regard to moral rights, except where prohibited by law.

Talent Search Entities bear no responsibility or liability for the following: (i) telephone or technical malfunctions that may occur; (ii) any incorrect or inaccurate information, any of the equipment or programming associated with or utilized in the Talent Search, or any technical or human error which may occur in connection with the Talent Search; (iii) any injury or damage to entrants or entrants' cats related to or resulting from participating in the Talent Search; or (iv) inaccessibility or unavailability of the Internet or any combination thereof. If, for any reason, the Talent Search is not capable of running as planned, including because of tampering, unauthorized intervention, fraud, technical failures, force majeure, or any other cause beyond the control of Talent Search Sponsor which may corrupt or affect the administration, security, fairness, integrity or proper conduct of the Talent Search, Talent Search Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Talent Search. Talent Search Sponsor reserves the right to change these Official Rules at any time, with or without notice.

11. Intellectual Property Rights. Each entrant shall retain ownership of all intellectual property rights in each Eligible Entry and Materials (including moral rights) subject to these Official Rules. However, by entering the Talent Search, and to the extent allowed by law, each entrant grants Sponsor and its affiliates, licensees, all partners, developers and third party marketing entities a non-exclusive, perpetual, worldwide, royalty-free license to edit, modify, cut, rearrange, add to, delete from, copy, reproduce, adapt, publish, exploit and use the Eligible Entry and Materials throughout the world, and in any manner, for trade, advertising, promotional, commercial, or any other purposes without further review, notice, approval, consideration, or compensation.

12. General Conditions: Talent Search Sponsor reserves the right to cancel, suspend and/or modify the Talent Search, or any part of it, if any fraud, technical failures or any other factor impairs the integrity or proper functioning of the , as determined by Talent Search Sponsor in its sole discretion. If terminated, Talent Search Sponsor may, in its sole discretion, select a winner from all non-suspect Eligible Entries received prior to such event. Sponsor, in its sole discretion, reserves the right to disqualify any individual it finds to be tampering with the operation of the or to be acting in violation of the Official Rules of this or any other or in an unsportsmanlike or disruptive manner and void all associated entries. Any attempt by any person to deliberately undermine the legitimate operation of the Talent Search may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages and other remedies (including attorneys' fees) from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. All interpretations of these Official Rules and decisions by Sponsor or its designee are final and binding in all matters related to the Talent Search.

The owner of the talent search winner will have the opportunity for his or her cat to be named "America's Next Cat Star" in the Program. During the Program, Talent Search Sponsor intends to feature a mixture of footage, including, but not limited to, clips from entrant's original video submission and footage from the in-home filming conducted when winner was a finalist. All aspects of the Program are subject to the requirements of the Program's producer and approval, which may be granted or withheld in such producer's sole discretion. Winner may not actually appear in the final version of the Program. Winner agrees to permit Talent Search Sponsor to use the Materials and any photograph, film, video, or audio recording of the winner acquired in association with this Talent Search (the "Footage") with the right for the full period of copyright, including all extensions and renewals thereof, and thereafter in perpetuity, throughout the world, to use, reuse, or modify all or any part of the Materials and Footage for the purpose of making and producing the Program and related content, and advertising, publicizing and exploiting the same, by all means, in any manner, and in all media, whether now known or hereafter devised, throughout the world, and to authorize others to do so. Neither the winner nor other party now or hereafter having an interest in the Materials and Footage shall have any right or action against Talent Search Sponsor or any other party arising out of any use of said Materials and Footage.

13. Governing Law: This Talent Search is governed by the laws of the State of Maryland, with jurisdiction and venue in Montgomery County, Maryland, and all claims must be resolved in the courts of Montgomery County, Maryland.

14. Entrant's Personal Information: Information collected from entrant is subject to Sponsor's Privacy Policy, available at http://corporate.discovery.com/privacy-policy/.

15. Winner List: For the name of winner, mail a self-addressed, stamped envelope to be received by [April 15, 2015] to: America's Next Cat Star Talent Search Winner, Discovery Communications, LLC, One Discovery Place, Silver Spring, MD 20910.
